Literary works on CD (eg. Audiobooks)

If you are a manufacturer of audio media (CD, Vinyl, Music Videos on DVD, etc.), and you intend to play music, video clips, live concerts, operas, ballets and choreographies, or audio books, plays, radio, literature etc., before play back in the master medium copies, you have an obligation to pay the fees due to copyright for recording, reproduction in copies and distributing them. These activities are in fact subject to the rights exclusive author (Articles 13 and 61 of Law no. 633/1941).

To play media on opera in audio or video format (including "critical editions" of public works domain), choreography, ballet, literary works (audiobooks), theatrical and broadcast works, you have to ask the prior authorization to authors or holders of rights, including by means of the SIAE by contacting the respective departments:

Lyric Department for lyrical and choreographic works and critical editions Department O.L.A.F. for literary works (p. ex. audiobooks)

Department D.O.R. for theater, radio etc.

Under Article. 181 bis of Law no. 633/1941, the media, the SIAE marks must be applied, that have a unit cost of € 0.0310; the unit cost is reduced to € 0.0181 in the case of media distributed free of charge or ons, publications offered for sale with no increase in the price normally (D.P.C.M. December 21, 2001).

The permit issued by SIAE:

Concerns only the copyright in the recording, reproduction and distribution of the copies of Sun works managed by SIAE, and the author retains the right to object to any distortion, cut or other modification of his works (Articles 20 and following of Law no. 633/1941).

Does not concern the rights related to copyright law (72 and subsequent articles of Law no. 633/1941), such as those that belong to the owner of the original master recording (of the Phonographic Industry, radio, television, etc.) or to performers.

The online portal for CD, musical videos, LP, etc. licenses (Licences DRM2 on line) allows you to forward the requests for licences and stickers, by communicating all the carrier data: in this way, you can avoid the manual filling in of the forms and any typing mistakes. You are guided in the online insertion of data by clicking on the available options suggested  and by short explanations.
To access the service for the first time, you will have to sign the registration form and send it via fax to the following number
The DRM office reserves the right to request further explanations or identifying details before granting you the licence to access the online service.
Once the preliminary phase is finished, you will receive the access credentials and the user manual. From now on, by connecting to the special web area, you can send all the new licence requests and the reprinting requests.

If you are sending a licence request for the first time, we ask you to read the information for the new phono/video producers.
You will have to fill in and sign the licence request on the DRM2 form, then scan the form and send it by e-mail with the Audio Label Copy and a copy of the label carrier to

In case of reprintings, it will be enough to fill in and send the DRM2RIS form, which you received with the first licence confirmation and at every following reprinting licence. The DRM2RIS is partially pre-filled and other attachments are not necessary.

For every licence request received, the DRM office will answer by sending a message to your email address with the result of your request examination and the amount that you must pay.
After the payment, which you can make by Payment by Advice (payment against note) or wire transfer to:

To calculate the fees due for any kind of reproduced works managed by SIAE (musical, opera, literary, etc.) the percentage of 9.009% for CDs and of 7.432% for DVDs is to be applied on the price charged for the retailer  (the list price net of VAT that is applied by the wholesalers to the retailers before discounts).

In case of sale to the public with fixed retail price (stamped upon the package), the percentages mentioned above are of 8% for CDs and 6.6% for DVDs and they are to be applied on the price to the public before taxes.
Rights are collected only on the works managed by SIAE. The fee to be paid can never be lower than the minimum fee provided for the format of carrier/package type, it takes into account the number and duration of the works reproduced and it decreases proportionally to the duration of the works not managed by SIAE. The minimum fees are applied also to the carriers distributed free of charge.
