Public Register Software

All the published computer programs that respect the originality and creativity requisites can be registered to the Public Register for Software so they can be identified as intellectual properties.

Moreover, it is possible to register all the deeds transferring all or parts of rights to the economic use related to programs which are already registered. Deeds which are rights of use or warranty on rights to the economic use of the program, and acts of division or acts of society of rights of use can be also registered.

To register a program, the applicant must send a “declaration” and a “description” to SIAE more than, of course, a sample of the program to deposit on a write-once digital device (CD-ROM, DVD).

The request/declaration of registration of a program, on the appropriate form 349), must be sent to SIAE filled and signed in original.

On the form 349 a virtual stamp duty of € 16.00 charged to the depositor will be placed by SIAE Offices. In case authors are more than two, the instructions regarding a third or more authors must be inserted on the back on the form, in the appropriate “integrations” field.

Each program must be declared separately by filling the declaration/request form 349 in every field.

If the declarant is not the author, it is possible to insert a pseudonym or “anonymous” in the “Author” field. In case authors are more than two, the instructions regarding a third or more authors must be inserted on page 2 of the form, in the appropriate “integrations” field.

It is essential to indicate place and date of publication of the software (page 2).

A copy of the program must be delivered on a write-once digital device (CD-ROM, DVD) in hard case together with the filled form. The device must have a label with the title of the program and the signature(s) of the applicant(s) on it. In alternative, the signature of the applicant(s) with permanent marker must be placed, directly on the disk.

The receipt of the payment for the fixed fees must be attached to the declaration and the sample of the program. The payment must be done on the account details indicated below by wire transfer or cheque (detailing the dedication) on the account number 76808005, headed to SIAE OLAF Section Viale della Letteratura 30 – 00144 Rome. If at the helpdesk, the payment can be done by cash before 12.30 pm or by POS.

In short: what do I need to register a computer program in the Public Register for Software?

In order to register a computer program in the Public Register for Software you need:

- Declaration/request form (Form 349), complete in all fields.

- A sample of the software, to be delivered on a write-once digital device (CD-ROM, DVD) in hard case, where the title of the software and the signature(s) of the applicant(s) are on a label or directly written on the device with permanent marker.

- Receipt of the payment for fixed fees to SIAE.

Each deed must be declared separately by filling the declaration/request form 346 in every field and signed on every page.

It is necessary to send SIAE a certified copy of the public deed or of the authenticated private contract by a notary, specifying the subject in the registration. Both the public deed and the private contract must result as already registered in the Register Office.

The receipt of the payment for the fixed fees must be sent to SIAE, together with the declaration and copy of the deed. The payment must be done on the account details indicated below by wire transfer or cheque (detailing the dedication) on the account number 76808005, headed to SIAE OLAF Section Viale della Letteratura 30 – 00144 Rome. If at the helpdesk, the payment can be done by cash before 12.30 pm or by POS.

For the software registration and for other related operations, the following fixed fees are due:

  • € 126.62 (virtual stamp duty of € 16.00 and stamp duty of € 2.00 included) for each program to register

  • € 117.66 (virtual stamp duty of € 16.00 and stamp duty of € 2.00 included) for each deed to register

  • € 18.99 (virtual stamp duty of € 16.00 included) for each certificate of registration

  • € 28.07 (virtual stamp duty of € 16.00 included) for each certificate of documents or deeds

  • € 0.60 per page for each certified copy of registrations or documents or deeds, in addition to the related certification rights

The opening hours to the public are the following: from Monday to Friday from 9.15 am to 1.15 pm; from Monday to Thursday from 3 to 4.30 pm.

WARNING: the payment methods directly at the General Directorate in Rome (Viale della Letteratura, 30) are the following:

  • In the morning, the payment can be made in cash or by cheque at the Public Cinematographic Register helpdesk (3rd floor) from 9.15 am to 12.30 pm or at the Original Works Deposit Office by POS.

  • From 12.30 to 1.15 pm and during the afternoon opening hours (from Monday to Thursday, from 3 to 4.30 pm), the payment can be made at the Original Works Deposit Office exclusively by POS (debit or credit card).
