How to apply - Radio and Television Works

SIAE is the main society for the protection, collection, distribution of the remuneration related to authors’ rights and to protected repertoires in Italy and Worldwide.

If the authors of radio and television works wanted to manage the rights of their authorship personally, they should organize themselves individually to check the use of their works, provide the required authorizations and pay the remunerations. In practice, this would be difficult to achieve, especially considering the ongoing development of the types of use, thanks to the recent technologies.

The SIAE subscription provides you with a widespread organisation in Italy and Worldwide that checks the use of your works everywhere and in any way it happens, issues authorizations, collects remunerations and distribute them among al the rightful claimants. For this reason, SIAE negotiates with the radio and television operators economic conditions and regulations in the best interest of the members for this specific repertoire.

By subscribing with SIAE, you become part of an organisation that has famous authors members from all over the world, and that provides you with more authority in case of economic claims and negotiations.

A clarification first: the music protection is of the DOR Section competence only if it is “original music”, it means specifically composed for "operette", "musical comedies", "dramatic work with original music" or "theatrical fantasy". The “original music” and the literary text must be one work. For this reason, the original music must be declared together with the author of the literary part as a collaboration work (Arts. 33-37 of the law of the author’s right).

You can apply for the SIAE protection for work of the DOR Section competence, as the author of the literary part and/or the author of the musical part by submitting:

1. The membership application or the mandate application in case you are not interested in exercising the right – reserved to “Members” only – to take part to the Society Assembly and vote for the relevant deliberations according to the agenda, such as the appointment of the components of the Supervisory Board (Arts. 9, 10, 11 and 12 of the SIAE Statute).

In case you are under 16, you will need to submit your personal information, Social Security Number and your parental authority’s signature on the application. 

From the 1st of January 2015, the membership is free of charge for all authors up to 30 years old. Alternatively to the membership, the authors up to 30 years old can obtain a free of charge mandate, which requires, however, the payment of a stamp duty fee.

The free membership or mandate terminates on the 31st of December of the year when the member has got to the age of 30.

We remind you that by becoming our Member or Principal, you fully accept all our regulations contained in the Statute and in the SIAE General Regulations, posted on the Law Library section on our website.

2. The declaration of at least one work, by submitting the appropriate form, which must be signed and completed, together with a work sample of its definitive and dramatized draft.

Once you become a Member or a Principal, the deposit of any further theatrical or radio and television work will not require any additional fees. SIAE will administer your works until the termination of the membership or mandate with no expiry date or renewal.

6. copy of your ID. Please make sure that the document has not expired and that both your personal data and your nationality are clear.

7. A copy of your Social Security Number. If you live abroad, you need to contact the Italian Consulate for your Social Security Number.

Once you have completed your application form for the membership or for the mandate, if you comply with all the requirements, you can obtain the extent of the protection also for other qualifications within the same Division or other Divisions. Should you so wish, you can request the recognition of your stage name or the authorization to use a pseudonym.

You can apply for the SIAE protection for works of the Drama and Radio and Television Section competence as publisher of radio and television works by submitting:

1. A request for a quote for the company name (or business name) that the Company intends to use, to prevent any confusion with other publishing companies already registered with the Society itself or with foreign Societies who have a reciprocal representation relationship with SIAE. Such company name (or business name) recognized by SIAE must correspond exactly with the company name or business name, and not with the label or brand name used for the publishing activity. The availability of such company name is revoked if the documentation is not submitted within and no later than 90 days from its recognition, as indicated on paragraph 2.

2. After receiving the approval for the company name, membership application or mandate application accompanied by the consent of the processing of personal data and signed by the owner of the company (or by the legal representative of the society),

and by the payment of the administrative right for the recognition of the company name and of the amount related to the management costs. Furthermore, the “Mandating” publisher will have to pay the stamp duty fee.

“Members” only have the right to take part to the Society Assembly and vote for the relevant deliberations according to the agenda,

including the appointment of the Supervisory Board (Arts. 9, 10, 11 e 12 of the SIAE Statute).

3. If the company you are applying for has been set up for less than two years and the initial Publishing fund consists of authors’ works, administered by SIAE, under 30 years old; or if it is a sole proprietorship whose owner is up to 30 years and whose initial Publishing fund consist of authors’ works, administrated by SIAE, under 30 years old, in this case the owner will be exempt from the payments mentioned above and also from the payment of the contribution or of the annual fee and also:

a) for the following two years after the membership and mandate take effect (with the exception of the stamp duty fee, as this is required in case of a “Mandate”),

b) it runs until the owner has reached the age of 30, if related to a society.

4. If the Company has been established in the form of a partnership, the following additional documentation must be submitted:

a. The Instrument of incorporation and statute that certify that the society performs publishing activities of Musical Works (in original or certified copy);

b. A declaration of certification signed by the legal representative of the Company that declares the registration to the Companies Register and the Social Security Number and VAT number.

Instead, if it is a sole proprietorship:

Declaration of certification signed by the legal representative of the Company that declares the registration to the Companies Register and the Social Security Number and VAT number, and also that the company performs publishing activities of musical works .

5. A Birth and Nationality Certificates Declaration signed by the legal representative of the Company. If the Legal Representative is a foreign citizen, outside the European Union, a declaration with a notary certified signature (if in Italy), or countersigned by the relevant Italian Consulate (if abroad) can be submitted instead of the declaration.

6. A declaration of at least ten works, whose right of economic use has been purchased by the music publishing Company, as original publisher, except for the works the owner or the legal representative of the publishing company is author or co-author of. For such purposes, the specific declaration forms and the publishing contracts (in stamped-impressed paper for registration use) concluded with the authors concerned, must be submitted together with the works samples.

7. The communication on the selected method for collecting the royalties.

You can register with SIAE as a transferee of works assigned to the Drama and Radio and Television Section you need to submit:

1. A membership application or a mandate application including the consent of the processing of persona data and signed by the applicant (individual, owner of a sole proprietorship, legal representative of a company) together with the payment of the amount corresponding to the management costs, and of the first yearly fee, if “Member”, or of the first annual payment, if “Principal”. This payment will be required every year.

“Members” only have the right to take part to the Society Assembly and vote for the relevant deliberations according to the agenda, such as the appointment of the components of the Supervisory Board (Arts. 9, 10, 11 and 12 of the SIAE Statute).

2. If the Company is established as a Society:

- The instrument of incorporation and statute (in original or certified copy);

A declaration signed by the legal representative of the Company, who certifies the registration in the Companies Register and the Social Security number and VAT number;

- A declaration of certification signed by the legal representative of the Company, who certifies the date of birth and the nationality.

If it is a Sole Proprietorship, instead:

- A declaration of certification signed by the legal representative of the company who certifies the registration in the Companies Register and of the VAT number;

- Declaration of certification signed by the legal representative of the company who certifies, the date of birth and the nationality.

For an individual:

- A declaration of certification signed by the applicant, who certifies the date of birth and the nationality.

Regarding the declaration of certificate of birth and nationality, if the applicant is a foreign citizen, outside the European Union, a declaration with a certified signature by a notary (if in Italy) or countersigned by the competent Italian Consulate (if abroad) can be submitted.

3. A depositing of the contract of transfer of the economical use rights of at least a work included in the protected genres Section.

4. A depositing of the above mentioned work by submitting a declaration form signed by all the right claimants, whose owner of the performance rights is the applicant. You can request the form at the SIAE Office or, in alternative, you can download it from the website, filled in and used for the declaration at the General Directorate, or the local offices or by mail.

5. A communication on the selected method of fee collection.

You can register with SIAE as a transferee of works assigned to the Drama and Radio and Television Section you need to submit:

1. A membership application or a mandate application including the consent of the processing of persona data and signed by the applicant (individual, owner of a sole proprietorship, legal representative of a company) together with the payment of the amount corresponding to the management costs, and of the first yearly fee, if “Member”, or of the first annual payment, if “Principal”. For an individual:

- A declaration of certification signed by the applicant, who certifies the date of birth and the nationality.

Regarding the declaration of certificate of birth and nationality, if the applicant is a foreign citizen, outside the European Union, a declaration with a certified signature by a notary (if in Italy) or countersigned by the competent Italian Consulate (if abroad) can be submitted.

If you need to request the SIAE protection in case of death of a Member or a Principal, or to confer a posthumous mandate for works under the DOR Section competence as the author’s of radio and television works heir, you will need to submit:

1. A statutory declaration in lieu of an oath, drawn up by a notary, or a declaration ln lieu of an oath issued in accordance with D.P.R. n. 445 of the 28.12.2000 that certifies:

- Name, surname, marital status and date of death of the previous member;

- Succession type: will or legitimate;

- Name, surname, place and date of birth of the legitimate heirs, executors, legal heirs, current domicile and succession participation rate;

- Name and surname of the legal representative on behalf of any minor heir, interdicted person or incapacitated;

- Name, surname, marital status and date of death of the previous member;

- Succession type: will or legitimate;

- Name, surname, place and date of birth of the legitimate heirs, executors, legal heirs, current domicile and succession participation rate;

- Name and surname of the legal representative on behalf of any minor heir, interdicted person or incapacitated;

- Wedding date (if that’s the case), name, surname, place and date of birth, and surviving spouse domicile (Please specify if from first or second marriage);

- If a separation or divorce judgment against the surviving spouse has been delivered in any country, or if a marriage annulment has been delivered (if it does, please indicate the details of the judgment concerned) as final judgment when the succession has started;

- Personal details and date of birth of the divorced spouse (or, if dead, date of death as well), in case of a previous marriage;

- In case of the existence of a not appealed or asserted will;

- That there are no other claimants to the succession a part from the rightful claimants mentioned in the deed;

- That the document has been drawn up for the SIAE registration of the heirs and this implies that they accept the inheritance of the legal predecessor.

If the statutory declaration in lieu o fan oath is sent by mail, this must be accompanied by a copy of a valid ID of the declarant party. If necessary, SIAE reserves the right to require the affidavit.

2. A certified copy of the waiver act of the inheritance, if that’ the case, from one of the heirs of the succession.

3. A certified copy of the publication minutes of the will resulting as not appealed or asserted.

4. A certified copy of the divorce judgment or marriage annulment, if that’s the case.

5. In case there are several rightful claimants to the succession, a stamp-impressed paper mandate with certified signatures is required, in order to appoint a representative body at SIAE. This position can also include the authority of collection of income or just carry out administrative purposes, by reminding that it is appropriate to indicate the inheritance participation fee. The mandate can be bestowed to one of the succession co-heirs or to a person outside the succession. In the second case, as indicated in paragraph 8, the application must be addressed to, " Joint heirship of ……………….", represented and administrated by …(name and surname of the representative). If the deed has been drawn abroad, the signatures must be approved for the authentication by the Italian Consulate.

6. A decree for the appointment of the guardian, if that’s the case, for minor heir or interdicted person and of a trustee for the emancipated or incapacitated minor heirs, or issued in accordance with D.P.R. n. 445 of the 28.12.2000.

7. A measure by the Judge supervising a guardianship to authorise the guardian or trustee, or the applicant in the case referred to paragraph 1 of Art. 321 of the Civil Code, to accept the inheritance, donation or legacy and to collect the accrued revenue and the revenue to come on behalf of the minor, interdicted person or incapacitated. In case of parental authority, the Judge’s authorization is enough for the parent to collect the accrued revenue and the revenue to come on behalf of the minor.

8. The SIAE application form, completed in all its parts and signed by the heir, or in case of several heirs, by their representative.

9. Declaration of certification that certifies the place, date of birth and nationality of the heir or of the heirs’ representative.

10. Proof of the planned payments .

11. Consent to the processing of personal data.

12. The communication on the selected method for the royalties collection.

13. copy of your ID. Please make sure that the document has not expired and that both your personal data and your nationality are clear.

14. copy of your Social Security Number. If you live abroad, you need to contact the Italian Consulate for your Social Security Number. In order to confer a posthumous mandate, in case the author was not registered with SIAE, the heir or the heirs’ representative will also have to declare the author’s works by submitting the appropriate declaration form.

In order to confer a posthumous mandate, in case the author was not registered with SIAE, the heir or the representative of the heir, in addition, will have to declare the works of the author by using the appropriate form. Please note that the depositing of additional works by the heirs doesn’t imply any additional fees. The works mentioned above will be administrated by SIAE fo the entire duration of the mandate established by the heirs, with no expiry date or renewal.
